Terms of Service

1. Agreement to Terms

By accessing or using the EzTool platform ("Platform"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform. EzTool provides an online marketplace connecting tool owners ("Listers") with individuals seeking to rent tools and equipment ("Renters").

2. Eligibility

You must be at least 18 years old to use EzTool. By using the Platform, you represent that you are of legal age and have the legal capacity to enter into binding agreements.

3. Rental Agreements

Every rental on EzTool is governed by a binding digital Rental Agreement signed by the Renter prior to receiving the equipment. By signing, the Renter acknowledges:

  • Full replacement liability for loss or theft of the rented item
  • Responsibility for any damage caused during the rental period
  • Agreement to indemnify the Lister against third-party claims arising from the Renter's use
  • Obligation to return the item in the same condition as received, subject to normal wear

4. Payments, Fees & Deposits

All payments are processed securely through Stripe. When a rental is confirmed:

  • Rental fee: Charged to the Renter at booking. EzTool retains a 10% platform fee; 90% is transferred to the Lister upon safe return confirmation.
  • Security deposit: Charged upfront and held in escrow. Refunded in full to the Renter when the Lister confirms safe return.
  • Damage or loss: If the Lister files a damage or loss claim, the deposit is retained and not refunded pending resolution.

EzTool is not responsible for disputes between Listers and Renters beyond the deposit mechanism described above. All refund decisions related to deposits are at EzTool's discretion pending evidence review.

5. Lister Responsibilities

Listers are responsible for:

  • Accurately describing their tools and equipment, including known defects
  • Ensuring their equipment is safe to use and does not create an unreasonable hazard
  • Setting a fair deposit that reflects the value of the item
  • Promptly confirming returns or filing claims within 48 hours of the rental end date

6. Renter Responsibilities

Renters are responsible for:

  • Using rented equipment only for its intended purpose
  • Returning items on time and in the condition they were received
  • Notifying the Lister and EzTool immediately in the event of damage, loss, or theft
  • All costs associated with damage, loss, or theft as outlined in the Rental Agreement

7. Damage Claims

Listers may file a damage claim via the Platform within 48 hours of rental completion. Claims must include a written description and, where possible, photographic evidence. EzTool reserves the right to make final determinations on deposit allocation. Submission of false or fraudulent claims may result in account termination.

8. Prohibited Uses

You may not use EzTool to:

  • List tools or equipment you do not own or have authority to rent
  • Engage in fraudulent transactions or misrepresent item condition
  • Circumvent Platform payments (e.g., arranging payment outside the Platform)
  • Harass, threaten, or engage in abusive behavior toward other users

9. Limitation of Liability

EzTool is a marketplace platform and is not a party to rental agreements between Listers and Renters. To the fullest extent permitted by law, EzTool shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Platform or rental transactions. EzTool's total liability shall not exceed the platform fees collected in the transaction giving rise to the claim.

10. Account Termination

EzTool reserves the right to suspend or terminate accounts at its discretion for violations of these Terms, fraudulent activity, or behavior deemed harmful to the Platform or its users.

11. Changes to Terms

We may update these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
